TERMS

Terms of use

Short version: be 18 or over, upload only what you are allowed to upload, and treat the people in your feed the way you would at a table with them. The rest is the long version.

Last updated: 8 October 2026

1. Scope

These terms apply between you and Benjamin Amhof, Hertensteinstrasse 2, 6004 Lucerne, Switzerland (“we”) for the use of the CheersFeed app. By confirming them in onboarding and by continuing to use the app you accept them.

2. What CheersFeed is

A private photo and meet-up app for groups of friends: you capture the moments of a night, share them with your friends, meet up in rounds and get the rewind afterwards. CheersFeed is free; there are no subscriptions and no in-app purchases.

CheersFeed is entertainment. It is not a drinking game and not a contest: there are no leaderboards that spur more drinking, and we pay nobody to drink. There is no claim to uninterrupted availability — we run the app as well as we can, not under a service level agreement.

CheersFeed may contain advertising and paid partnerships with drinks brands, venues and event organisers. We choose them ourselves and label them clearly as advertising or partnership — visibly separate from the private moments. Our advertising is bound by the limits of the Alcohol Act without exception: it never targets minors and never encourages more or riskier drinking (Art. 42b AlkG). Where a moment names a venue or an event, that is the private note of the person who created it — not advertising by us, not a recommendation and not a partnership with that venue. They are responsible for it themselves (section 6).

3. Account and minimum age

  • Using the app requires an account. Signing in goes through email and password, Google or Apple.
  • Use is permitted from 18 years of age. In onboarding you enter your date of birth and thereby declare that you have reached it. If we learn of an account belonging to someone younger, we suspend it.
  • An account belongs to one natural person. Do not pass on your credentials, and report any suspected misuse to team@slackers.dev.
  • You can delete your account in the settings at any time; that removes your content and data. If you no longer have access to the app, you can also do it through this website.

4. Your content stays yours

Nothing changes about your photos and texts: the rights stay with you. You grant us a simple, non-exclusive, royalty-free and territorially unlimited licence to store them, process them technically (scaling, preparing them for the rewind, and checking them automatically for prohibited content) and deliver them to the people you meant them for — solely to operate the app. That licence ends when you delete the moment or your account, except for copies that remain briefly in backups for technical reasons.

We do not sell your content and do not use it for advertising.

5. Intellectual property in CheersFeed

The app itself — the name “CheersFeed”, the logo, software, source code, design and all text outside your own content — belongs to us or our licensors and is protected by copyright and trademark law. By using the app you receive a simple, non-transferable right to use it within these terms. You may not copy, reverse-engineer, modify or reuse parts of the app for your own offerings, except where the law mandatorily provides otherwise.

6. What is not allowed

  • Content you hold no rights to — and pictures of people who did not agree to them. Ask if in doubt; in Switzerland this is also a matter of personality rights (Art. 28 CC). The same goes for people without a CheersFeed account: obtaining their consent before showing them recognisably is your job — we do not check in advance, we act on reports (section 7).
  • Depictions of violence, pornography, racism, insults, bullying, threats.
  • Any depiction of child sexual abuse or exploitation (CSAE). We remove such content immediately, permanently ban the account and report the case to the competent authorities.
  • Content that entices minors to drink, and any form of alcohol advertising within the meaning of the Alcohol Act (Art. 42b AlkG).
  • Advertising, spam, chain messages, commercial offers.
  • Automated extraction from the app, circumventing technical safeguards, attacks on our infrastructure.

If you show a person recognisably without their consent, you indemnify us against all claims that person or third parties bring against us because of it, and you bear the costs of a reasonable legal defence. This does not apply where the breach is our own fault.

7. Reporting, blocking, moderation

Every moment and every comment can be reported, every person blocked. On top of that an automatic image classifier checks every uploaded moment for nudity and violence. We look at reported content within 24 hours. If content breaches section 6 we may remove it; for serious or repeated breaches we may suspend or delete the account. Where we suspect a criminal offence we reserve the right to involve the authorities. If you think a measure is wrong, write to team@slackers.dev.

8. Alcohol and personal responsibility

CheersFeed asks nobody to drink and rewards no volume. What you drink is your decision and your responsibility, along with everything that follows from it. Information in the app (places, maps, distances, recorded routes) is non-binding, can be wrong, is not medical advice and is no measure of your fitness to drive. Do not drive after drinking. More on the age rating page.

9. Availability, moments, data loss

That a moment disappears from the feed after 24 hours is a feature, not a fault. We do our best, but we owe no particular availability: maintenance, outages, changes to features or discontinuing the service are possible. If we discontinue it, we give you reasonable notice so you can save your content.

10. Liability

We are liable for intent and gross negligence, and for injury to life, body and health without limitation. Otherwise liability is excluded as far as the law permits — in particular for slight negligence, lost profit, data loss and indirect damage.

We expressly accept no liability for what happens in real life: for alcohol consumption and its consequences, for the way home, for accidents, for encounters arranged through the app, and for the content of other users. Users are liable for what they upload.

11. Map data and third-party services

The app uses Google Maps, Firebase and other Google Cloud services, as well as map data from OpenStreetMap. Google Maps’ own terms apply to the map display. Place data comes in part from © OpenStreetMap contributors (ODbL).

12. Termination

You can delete your account in the app at any time — how that works, even without access to the app. For serious or repeated breaches of section 6 we may suspend or delete your account (section 7). Even without a breach we may terminate an account with 30 days’ notice, for instance when we discontinue a feature or the service for certain groups of users; we tell you beforehand so you can save your content. Deletion ends the licence in section 4.

13. Changes to these terms

We may change these terms. We announce material changes in the app; you have to accept the new version on the next start. If you do not accept, you cannot continue using the app and can delete your account.

14. Governing law and jurisdiction

Swiss law applies, excluding its conflict-of-law rules and the CISG. The place of jurisdiction is Lucerne, Switzerland, unless mandatory provisions — in particular the consumer forum under Art. 32 CPC — provide otherwise. Should a provision be invalid, the rest remains in force.
